From random security checks at airports to the use of risk assessment in sentencing, actuarial methods are being used more than ever to determine whom law enforcement officials target and punish. And with the exception of racial profiling on our highways and streets, most people favor these methods because they believe they’re a more cost-effective way to fight crime.
In Against Prediction, Bernard E. Harcourt challenges this growing reliance on actuarial methods. These prediction tools, he demonstrates, may in fact increase the overall amount of crime in society, depending on the relative responsiveness of the profiled populations to heightened security. They may also aggravate the difficulties that minorities already have obtaining work, education, and a better quality of life—thus perpetuating the pattern of criminal behavior. Ultimately, Harcourt shows how the perceived success of actuarial methods has begun to distort our very conception of just punishment and to obscure alternate visions of social order. In place of the actuarial, he proposes instead a turn to randomization in punishment and policing. The presumption, Harcourt concludes, should be against prediction.

She has held Guggenheim and National Humanities Fellowships. She is best known for How to Be Human* Though an Economist (University of Michigan Press, 2000) and her most recent book, The Bourgeois Virtues: Ethics for an Age of Commerce (2006).

From Medicaid to Section 8 Housing Choice Vouchers, a large percentage of the annual US federal budget (approximately $1 trillion) is distributed through grants-in-aid, a policy tool that allocates aid to state and local governments rather than to individual Americans. When members of Congress use grants-in-aid to fund healthcare, housing, and other forms of support, they are not solely determining how much assistance one person receives. Instead, they can allot certain localities larger grants, which carry big implications for the quality of public services available to citizens living in different states.
Many reasonably assume that these assistance programs distribute funding to states impartially because they use statistical formulas based on population levels, poverty, and other characteristics that, ostensibly, measure need. However, in Politics by Formula, Leah Rosenstiel shows how this seemingly technocratic aspect of federal policymaking is deeply affected by both the structure of political institutions and the motivations of elected officials. The increasing racial and ethnic diversity of the US population raises the question of whether the race and ethnicity categories and definitions used by federal statistical agencies to create demographic statistics on which government officials, business decision-makers, and private citizens rely fully reflect the changing population. Official definitions of existing race and ethnic groups do not always command wide agreement, and over time, some definitions that were once widely accepted may become less so based on political, legal, and social factors. Comparable measures of race and ethnicity over time are needed to accurately track historical changes in economic and social outcomes, as well as racial and ethnic segregation.
