Listing every right that a constitution should protect is hard. American constitution drafters often list a few famous rights such as freedom of speech, protection against unreasonable searches and seizures, and free exercise of religion, plus a handful of others. However, we do not need to enumerate every liberty because there is another way to protect them: an "etcetera clause." It states that there are other rights beyond those specifically listed: "The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people." Yet scholars are divided on whether the Ninth Amendment itself actually does protect unenumerated rights, and the Supreme Court has almost entirely ignored it. Regardless of what the Ninth Amendment means, two-thirds of state constitutions have equivalent provisions, or "Baby Ninth Amendments," worded similarly to the Ninth Amendment.

This book is the story of how the "Baby Ninths" came to be and what they mean. Unlike the controversy surrounding the Ninth Amendment, the meaning of the Baby Ninths is straightforward: they protect individual rights that are not otherwise enumerated. They are an "etcetera, etcetera" at the end of a bill of rights. This book argues that state judges should do their duty and live up to their own constitutions to protect the rights "retained by the people" that these "etcetera clauses" are designed to guarantee. The fact that Americans have adopted these provisions so many times in so many states demonstrates that unenumerated rights are not only protected by state constitutions, but that they are popular. Unenumerated rights are not a weird exception to American constitutional law. They are at the center of it. We should start treating constitutions accordingly.

For a community or industry that is being ignored by big banks, the idea of starting up a new bank or credit union rarely figures as an option. In The Banks We Deserve, Abello shows advocates, organizers, and innovators that it can be done, that it is being done, and describes a path to support more community banks and credit unions.

In this book Paul Dumouchel argues that this paradoxical reversal of the state’s primary function into violence against its own members is not a mere accident but an ever-present possibility that is inscribed in the structure of the modern state. Modern states need enemies to exist and to persist, not because they are essentially evil but because modern politics constitutes a violent means of protecting us against our own violence. If they cannot—if we cannot—find enemies outside the state, they will find them inside. However, this institution is today coming to an end, not in the sense that states are disappearing, but in the sense that they are increasingly failing to protect us from our own violence. That is why the violent sacrifices that they ask from us, in wars and even in times of peace, have now become barren.

Judges play a central role in the American legal system, but their behavior as decision-makers is not well understood, even among themselves. The system permits judges to be quite secretive (and most of them are), so indirect methods are required to make sense of their behavior. Here, a political scientist, an economist, and a judge work together to construct a unified theory of judicial decision-making. Using statistical methods to test hypotheses, they dispel the mystery of how judicial decisions in district courts, circuit courts, and the Supreme Court are made.

The authors derive their hypotheses from a labor-market model, which allows them to consider judges as they would any other economic actors: as self-interested individuals motivated by both the pecuniary and non-pecuniary aspects of their work. In the authors' view, this model describes judicial behavior better than either the traditional “legalist” theory, which sees judges as automatons who mechanically apply the law to the facts, or the current dominant theory in political science, which exaggerates the ideological component in judicial behavior. Ideology does figure into decision-making at all levels of the federal judiciary, the authors find, but its influence is not uniform. It diminishes as one moves down the judicial hierarchy from the Supreme Court to the courts of appeals to the district courts. As The Behavior of Federal Judges demonstrates, the good news is that ideology does not extinguish the influence of other components in judicial decision-making. Federal judges are not just robots or politicians in robes.

Who determines the fuel standards for our cars? What about whether Plan B, the morning-after pill, is sold at the local pharmacy? Many people assume such important and controversial policy decisions originate in the halls of Congress. But the choreographed actions of Congress and the president account for only a small portion of the laws created in the United States. By some estimates, more than ninety percent of law is created by administrative rules issued by federal agencies like the Environmental Protection Agency and the Department of Health and Human Services, where unelected bureaucrats with particular policy goals and preferences respond to the incentives created by a complex, procedure-bound rulemaking process.
           
With Bending the Rules, Rachel Augustine Potter shows that rulemaking is not the rote administrative activity it is commonly imagined to be but rather an intensely political activity in its own right. Because rulemaking occurs in a separation of powers system, bureaucrats are not free to implement their preferred policies unimpeded: the president, Congress, and the courts can all get involved in the process, often at the bidding of affected interest groups. However, rather than capitulating to demands, bureaucrats routinely employ “procedural politicking,” using their deep knowledge of the process to strategically insulate their proposals from political scrutiny and interference. Tracing the rulemaking process from when an agency first begins working on a rule to when it completes that regulatory action, Potter shows how bureaucrats use procedures to resist interference from Congress, the President, and the courts at each stage of the process. This exercise reveals that unelected bureaucrats wield considerable influence over the direction of public policy in the United States.

In 2016, when millions of Americans voted for Donald Trump, many believed his claims that personal wealth would free him from wealthy donors and allow him to “drain the swamp.” But then Trump appointed several billionaires and multimillionaires to high-level positions and pursued billionaire-friendly policies, such as cutting corporate income taxes. Why the change from his fiery campaign rhetoric and promises to the working class? This should not be surprising, argue Benjamin I. Page, Jason Seawright, and Matthew J. Lacombe: As the gap between the wealthiest and the rest of us has widened, the few who hold one billion dollars or more in net worth have begun to play a more and more active part in politics—with serious consequences for democracy in the United States.

Page, Seawright, and Lacombe argue that while political contributions offer a window onto billionaires’ influence, especially on economic policy, they do not present a full picture of policy preferences and political actions. That is because on some of the most important issues, including taxation, immigration, and Social Security, billionaires have chosen to engage in “stealth politics.” They try hard to influence public policy, making large contributions to political parties and policy-focused causes, leading policy-advocacy organizations, holding political fundraisers, and bundling others’ contributions—all while rarely talking about public policy to the media. This means that their influence is not only unequal but also largely unaccountable to and unchallengeable by the American people. Stealth politics makes it difficult for ordinary citizens to know what billionaires are doing or mobilize against it. The book closes with remedies citizens can pursue if they wish to make wealthy Americans more politically accountable, such as public financing of political campaigns and easier voting procedures, and notes the broader types of reforms, such as a more progressive income tax system, that would be needed to increase political equality and reinvigorate majoritarian democracy in the United States.

African Americans have been in the vanguard of progressive social movements throughout American history, but they have been written out of many histories of social liberalism. Focusing on the 1920s and 1930s, as well as the Black Power movement, Dawson examines successive failures of socialists and Marxists to enlist sympathetic blacks, and white leftists’ refusal to fight for the cause of racial equality. Angered by the often outright hostility of the Socialist Party and similar social democratic organizations, black leftists separated themselves from these groups and either turned to the hard left or stayed independent. A generation later, the same phenomenon helped fueled the Black Power movement’s turn toward a variety of black nationalist, Maoist, and other radical political groups.

The 2008 election of Barack Obama notwithstanding, many African Americans still believe they will not realize the fruits of American prosperity any time soon. This pervasive discontent, Dawson suggests, must be mobilized within the black community into active opposition to the social and economic status quo. Black politics needs to find its way back to its radical roots as a vital component of new American progressive movements.

In April 1861, President Abraham Lincoln suspended the writ of habeas corpus along the military line between Washington, D.C., and Philadelphia. In the late nineteenth century, a new era began in American urban history, characterized by an explosion of both the populations and the proportions of cities, obliterating their traditional social and physical characteristics. Commercial businesses relocated, slums emerged around the core, and new residential areas were established along the periphery. The period was one of extreme disorder—labor and ethnic unrest, election violence, rising crime rates—but it was also a time of political innovation and civic achievement.

In documenting the changes Cincinnati experienced during  the Progressive Era, Zane L. Miller provides a clear perspective on the processes of urbanization that transformed the American city. His focus is political because politics provided continuity amid the diversity of city life. The most important aspect of political continuity in Cincinnati and in other cities was "bossism," often depicted as an example of corruption, but which was in many cities part of the quest for a new urban order. In Cincinnati, Boss George B. Cox's machine was a response to the disorder of the times; interestingly, the machine actually helped to control disorder, paving the way for later reforms. Miller carefully explores both the nature and the significance of bossism, showing how it and municipal reform were both essential components of the modern urban political system.

Originally published in 1968, Boss Cox's Cincinnati is considered a classic in the field of urban studies.

Big-city mayors, defense industry contractors, nonprofit executives, and other national proxies lobby incessantly for more federal spending. This proxy system chokes on chores such as cleaning up toxic waste sites, caring for hospitalized veterans, collecting taxes, handling plutonium, and policing more than $100 billion annually in “improper payments.” The lack of competent, well-trained federal civil servants resulted in the failed federal response to Hurricane Katrina and the troubled launch of Obamacare’s “health exchanges.”

Bring Back the Bureaucrats is further distinguished by the presence of E. J. Dionne Jr. and Charles Murray, two of the most astute voices from the political left and right, respectively, who offer their candid responses to DiIulio at the end of the book.

 “What is representation?” is a question that has been raised and discussed many times. In Bringing Representation Home, Michael A. Smith strays from the norm by asking instead, “How can we discover what representation is?” In pursuing the answer to this question, Smith focuses on what representation is in practice, not what it is in theory. Over the course of two legislative sessions, Smith interviewed and observed twelve state representatives in an effort to better understand and define their approaches to representation. He offers generalizations, but only after grounding his study in descriptions of representatives performing their jobs.
The twelve representatives are divided into four categories: Burkeans, in-district advocates, advocates beyond the district, and ombudspersons. Burkeans emphasize character and experience, advocates stress “socializing the conflict,” and ombudspersons underscore listening, responding, and compromising. Smith superbly builds his argument for this classification through an assortment of illustrative examples. He also makes a strong case that home style—the symbolic presentation that a representative makes at home in seeking political support from constituents—is a product of the interaction between the legislator’s personality and progressive ambition and the district’s characteristics and politics. Smith contends that the key to an effective representational strategy is for a representative to have not only an ideology that reflects the politics of his or her community, but also an understanding of the district’s interests, informed by interactions with organized constituencies at home.
            Smith helps personalize the legislators of this study, providing a balanced, realistic view. He also offers a new treatment of the representational roles concept, drawing on recent controversies in political science. In this context, he discusses works by Donald Searing, Richard Fenno, Burdett Loomis, and Malcolm Jewell, among others.
Because the nature of representation at the state level is such an important topic—one that will become even more important as state legislatures gain greater influence—Bringing Representation Home makes a vital contribution to political science literature. Written in an accessible and engaging style, this book will be of great interest to students and scholars of legislatures and state politics.

As President Barack Obama was sworn into office on January 20, 2009, the United States was abuzz with talk of the first African American president. At this historic moment, one man standing on the inaugural platform, seemingly a relic of the past, had actually been called by the moniker the “first black president” for years.

President William Jefferson Clinton had long enjoyed the support of African Americans during his political career, but the man from Hope also had a complex and tenuous relationship with this faction of his political base. Clinton stood at the nexus of intense political battles between conservatives’ demands for a return to the past and African Americans’ demands for change and fuller equality. The results were tremendously positive for some African Americans. For others, the Clinton presidency was devastating.

Before 1946 the congressional role in public administration had been limited to authorization, funding, and review of federal administrative operations, which had grown rapidly as a result of the New Deal and the Second World War. But in passing the Administrative Procedure Act and the Legislative Reorganization Act that pivotal year, Congress self-consciously created for itself a comprehensive role in public administration. Reluctant to delegate legislative authority to federal agencies, Congress decided to treat the agencies as extensions of itself and established a framework for comprehensive regulation of the agencies' procedures. Additionally, Congress reorganized itself so it could provide continuous supervision of federal agencies.

Rosenbloom shows how these 1946 changes in the congressional role in public administration laid the groundwork for future major legislative acts, including the Freedom of Information Act (1966), Privacy Act (1974), Government in the Sunshine Act (1976), Paperwork Reduction Acts (1980, 1995), Chief Financial Officers Act (1990), and Small Business Regulatory Fairness Enforcement Act (1996). Each of these acts, and many others, has contributed to the legislative-centered public administration that Congress has formed over the past 50 years.

This first book-length study of the subject provides a comprehensive explanation of the institutional interests, values, and logic behind the contemporary role of Congress in federal administration and attempts to move the public administration field beyond condemning legislative "micromanagement" to understanding why Congress values it.

Although everyone agrees on the need to make government work better, few understand public bureaucracy sufficiently well to offer useful suggestions, either theoretical or practical. In fact, some consider bureaucratic efficiency incompatible with democratic government.

Douglas Yates places the often competing aims of efficiency and democracy in historical perspective and then presents a unique and systematic theory of the politics of bureaucracy, which he illustrates with examples from recent history and from empirical research. He argues that the United States operates under a system of “bureaucratic democracy,” in which governmental decisions increasingly are made in bureaucratic settings, out of the public eye. He describes the rational, self-interested bureaucrat as a “minimaxer,” who inches forward inconspicuously, gradually accumulating larger budgets and greater power, in an atmosphere of segmented pluralism, of conflict and competition, of silent politics.

To make the policy process more competitive, democratic, and open, Yates calls for strategic debate among policymakers and bureaucrats and insists that bureaucrats should give a public accounting of their significant decisions rather than bury them in incremental changes. He offers concrete proposals, applicable to federal, state, and local governments, for simplifying the now-chaotic bureaucratic policymaking system and at the same time bolstering representation and openness.

This is a book for all political scientists, policymakers, government officials, and concerned citizens. It may well become a classic statement on the workings of public bureaucracy.
