During the decade of the 1850s, the Oregon Territory progressed toward statehood in an atmosphere of intense political passion and conflict. Editors of rival newspapers blamed a group of young men whom they named the “Salem Clique,” along with the Oregon Statesman newspaper that they controlled, for the bitter party struggles of the time. They accused the so-called Clique of dictatorship and corruption. They charged it with the intention of imposing slavery on the Territory. The Clique, they maintained, even conspired to establish a government separate from the United States, conceivably a “bigamous Mormon republic.”   
 
While not in agreement with some of the more extreme contemporary accusations against the Clique, many historians have concluded that its members were vicious men who were able, because of their command of the Democratic party, to impose their hegemony on the Oregon Territory’s inhabitants. Other scholars have seen them as merely another instance of the contentious politics of the period. 
 
Although the Salem Clique has been given considerable prominence in nearly every account of Oregon’s Territorial period, there has not been a detailed study of its role until now. What sort of people were these men? What was their impact on the issues, events, and movements of the period? What role did they play in the years after Oregon became a state? In The Salem Clique, Historian Barbara Mahoney sets out to answer these and many other questions in this comprehensive and deeply researched history.

The history of Lake Tahoe begins with the Washoe Indians who resided on its shores for thousands of years, with minimal impact on the landscape. The relatively brief American history at Lake Tahoe began in the mid-nineteenth century. Though awestruck by its beauty, the new arrivals were also intent on harvesting its abundant resources. In a mere half century, the basin’s forests and fisheries were destroyed, the lake’s pristine clarity dramatically reduced.

Left alone, nature healed itself, and by the 1960s mature forests once again surrounded the lake and its water clarity improved, with visibility more than one hundred feet deep. But also playing a part in the story were members of the bar who defended Jim Crow laws explicitly or implicitly and, in some cases, also served in state or federal government; lawyers who sat on state and federal benches and heard civil rights cases; and, finally, law professors who analyzed the reasoning of the courts in classrooms and public forums removed from the fray. With rich, copiously researched detail, Hoffer takes readers through the interactions of these groups, setting their activities not only in the context of the civil rights movement but also of their full political and legal legacies, including the growth of corporate private legal practice after World War II and the expansion of the role of law professors in public discourse, particularly with the New Deal. Seeing the civil rights era through the lens of law enables us to understand for the first time the many ways in which lawyers affected the course and outcome of the movement.

Something profoundly important occurred in early 19th century America that came to be called democracy. Since then hundreds of millions of people worldwide have operated on the assumption that democracy exists. Yet definitions of democracy are surprisingly vague and remarkably few reckon with its history. In Self-Rule, Robert Wiebe suggests that only in appreciating that history can we recognize how breathtaking democracy's arrival was, how extraordinary its spread has been, and how uncertain its prospects are.

American democracy arrived abruptly in the 19th century; it changed just as dramatically early in the 20th. Hence, Self-Rule divides the history of American democracy into two halves: a 19th century half covering the 1820s to the present, and a 20th century half, with a major transition from the 1890s to the 1920s between them. As Wiebe explains why the original democracy of the early 19th century represented a sharp break from the past, he recreates in vivid detail the way European visitors contrasted the radical character of American democracy with their own societies. He then discusses the operation of various 19th century democratic publics, including a nationwide public, the People. Finally, he places democracy's white fraternal world of equals in a larger environment where other Americans who differed by class, race, and gender, developed their own relations to democracy.

Wiebe then picks up the history of democracy in the 1920s and carries it to the present. Individualism, once integrated with collective self-governance in the 19th century, becomes the driving force behind 20th century democracy. During those same years, other ways of defining good government and sound public policy shunt majoritarian practices to one side. Late in the 20th century, these two great themes in the history of American democracy—individualism and majoritarianism—turn on one another in modern democracy's war on itself.

Finally, Self-Rule assesses the polarized state of contemporary American democracy. Putting the judgments of sixty-odd commentators from Kevin Phillips and E.J. Dionne to Robert Bellah and Benjamin Barber to the test of history, Wiebe offers his own suggestions on the meaning and direction of today's democracy. This sweeping work explains how the history of American democracy has brought us here and how that same history invites us to create a different future.

Frances Lee and Bruce Oppenheimer systematically show that the Senate's unique apportionment scheme profoundly shapes legislation and representation. The size of a state's population affects the senator-constituent relationship, fund-raising and elections, strategic behavior within the Senate, and, ultimately, policy decisions. They also show that less populous states consistently receive more federal funding than states with more people. In sum, Lee and Oppenheimer reveal that Senate apportionment leaves no aspect of the institution untouched.

The Affordable Care Act (ACA), the sweeping health care reform enacted by the Obama Administration in 2010, continues to be a contentious policy at the center of highly polarized political debates. Both before and after the law’s passage, political elites on both sides of the issue attempted to sway public opinion through two traditional approaches: messaging and policymaking itself.  They operated under the assumption that the public’s personal experiences toward the law would make them more favorable. Yet these tried-and-true methods have had limited influence on public attitudes toward the ACA. Public opinion towards the ACA remained stable from 2010 to 2016, with more Americans opposing the law than supporting it. It was only after Donald Trump was elected in 2016 and the prospect of the law being repealed became a reality that public opinion swung in favor of the ACA. If traditional methods of influencing public opinion had little impact on attitudes towards the ACA, what did? In Stable Condition, political scientist Daniel J. Hopkins draws on survey data from 2009 to 2020 to assess how a variety of factors such as personal experience, political messaging, and partisanship did or did not affect public opinion on the ACA.
 
Hopkins finds that although personal experience with the ACA’s Medicaid expansion increased favorability among low-income Americans, it did not have a broader overall impact on public opinion. Personal experience with the Health Insurance Marketplace did not increase wider support for the ACA either. Due to the complex nature of the law, users of the Marketplace often did not realize they were benefiting from the ACA. Therefore, perceptions of the Marketplace were shaped by high-profile issues with the enrollment website and opposition to the individual mandate. These experiences ultimately offset one another, resulting in little discernable change in public opinion overall. Hopkins argues that political polarization was also responsible for elite’s limited influence and that public opinion on the ACA was largely determined by partisanship and political affiliation. Americans quickly aligned with their party’s stance on the law and were resistant to changing their beliefs despite the efforts of political elites. 
 
Stable Condition is an illuminating examination of the limits of elites’ influence and the forces that shaped public opinion about the Affordable Care Act.

Many of the oldest and largest Western cities today are undergoing massive economic decline. The State and the City deals with a key issue in the political economy of cities—the role of the state. Ted Robert Gurr and Desmond S. King argue that theoreticians from both the left and the right have underestimated the significance of state action for cities. Grounding theory in empirical evidence, they argue that policies of the local and national state have a major impact on urban well-being.

Gurr and King's analysis assumes modern states have their own interests, institutional momentum, and the capacity to act with relative autonomy. Their historically based analysis begins with an account of the evolution of the Western state's interest in the viability of cities since the industrial revolution. Their agument extends to the local level, examining the nature of the local state and its autonomy from national political and economic forces.

Using cross-national evidence, Gurr and King examine specific problems of urban policy in the United States and Britain. In the United States, for example, they show how the dramatic increases in federal assistance to cities in the 1930s and the 1960s were made in response to urban crises, which simultaneously threatened national interests and offered opportunities for federal expansion of power. As a result, national and local states now play significant material and regulatory roles that can have as much impact on cities as all private economic activities.

A comparative analysis of thirteen American cities reflects the range and impact of the state's activities at the urban level. Boston, they argue, has become the archetypical postindustrial public city: half of its population and personal income are directly dependent on government spending. While Gurr and King are careful to delineate the limits to the extent and effectiveness of state intervention, they conclude that these limits are much broader than formerly thought. Ultimately, their evidence suggests that the continued decline of most of the old industrial cities is the result of public decisions to allow their economic fate to be determined in the private sector.

Since the US Constitution came into force in 1789, it has been amended just twenty-seven times, with ten of those amendments coming in the first two years following ratification. By contrast, state constitutions have been completely rewritten on a regular basis, and the current documents have been amended on average 150 times. This is because federal amendments are difficult, so politicians rarely focus on enacting them. Rather, they work to secure favorable congressional statutes or Supreme Court decisions. By contrast, the relative ease of state amendment processes makes them a realistic and regular vehicle for seeking change.

With State Constitutional Politics, John Dinan looks at the various occasions in American history when state constitutional amendments have served as instruments of governance. Among other things, amendments have constrained state officials in the way they levy taxes and spend money; enacted policies unattainable through legislation on issues ranging from minimum wage to the regulation of marijuana; and updated understandings of rights, including religious liberty, equal protection, and the right to bear arms. In addition to comprehensively chronicling the ways amendments shape politics in the states, Dinan also assesses the consequences of undertaking changes in governance through amendments rather than legislation or litigation. For various reasons, including the greater stability and legitimacy of changes achieved through the amendment process, he argues that it might be a more desirable way of achieving change.

But whereas others call for downsizing the federal government, Bok argues that government is essential to achieving America's goals. In short, Ronald Reagan was only half right. For white people, these policy changes have involved a rising number of generous benefits submerged within America’s tax code, which taken together cost the government more than Social Security and Medicare combined. Political attention focused on this has helped make welfare and taxes more visible representations of government for white Americans. As a result, white people are left with the misperception that government does nothing for them, apart from take their tax money to spend on welfare. Distrust of government is the result. For people of color, distrust is also rampant but for different reasons. Over the last fifty years, America has witnessed increasingly overbearing policing and swelling incarceration numbers. These changes have disproportionately impacted communities of color, helping to make the criminal legal system a unique visible manifestation of government in these communities.

While distrust of government emerges in both cases, these different roots lead to different consequences. White people are mobilized into politics by their distrust, feeling that they must speak up in order to reclaim their misspent tax dollars. In contrast, people of color are pushed away from government due to a belief that engaging in American elections will yield the same kind of unresponsiveness and violence that comes from interactions with the police. The result is a perpetuation of the same kind of racial inequality that has always been present in American democracy. The State You See is essential reading for anyone interested in understanding how the American government engages in subtle forms of discrimination and how it continues to uphold racial inequality in the present day.

During the Sixties the nation turned its eyes to San Francisco as the city's police force clashed with movements for free speech, civil rights, and sexual liberation. These conflicts on the street forced Americans to reconsider the role of the police officer in a democracy. In The Streets of San Francisco Christopher Lowen Agee explores the surprising and influential ways in which San Francisco liberals answered that question, ultimately turning to the police as partners, and reshaping understandings of crime, policing, and democracy.

The Streets of San Francisco uncovers the seldom reported, street-level interactions between police officers and San Francisco residents and finds that police discretion was the defining feature of mid-century law enforcement. Postwar police officers enjoyed great autonomy when dealing with North Beach beats, African American gang leaders, gay and lesbian bar owners, Haight-Ashbury hippies, artists who created sexually explicit works, Chinese American entrepreneurs, and a wide range of other San Franciscans. Unexpectedly, this police independence grew into a source of both concern and inspiration for the thousands of young professionals streaming into the city's growing financial district. These young professionals ultimately used the issue of police discretion to forge a new cosmopolitan liberal coalition that incorporated both marginalized San Franciscans and rank-and-file police officers. The success of this model in San Francisco resulted in the rise of cosmopolitan liberal coalitions throughout the country, and today, liberal cities across America ground themselves in similar understandings of democracy, emphasizing both broad diversity and strong policing.

When the Soviet Union launched Sputnik, the Red Scare seized the American public. While President Eisenhower cautioned restraint, his hand was forced, and NASA’s budget had increased five thousand percent over its pre-Sputnik levels by the time President Kennedy proposed landing a man on the moon. Spending on the space race is in no way unique; Almost every policy area has its own Sputnik-type story, where waves of popular support for an idea (or disillusionment with a previous one) created new political priorities, resulting in dramatic changes to the budget or compelling agencies to respond quickly with little knowledge or preparation. Is this instability an inherent feature of the policy process, or is it possible for an agency to deal with problems in a way that insulates it from swings in public opinion and thus imposes some stability on the decision making process?
           
Derek A. Epp argues that some agencies can indeed do that and that instability is at least partially a function of poor institutional design. While it is inherently more challenging to maintain stability around complex problems like immigration or climate change, the deliberative process itself can affect the degree of stability around an issue. Epp looks at whether agencies follow a deliberative model for decision making, in which policies are developed by means of debate among a small group of policymakers, or a collective model, in which the opinions of many people are aggregated, as with the stock market. He argues that, in many instances, the collective model produces more informed and stable policy outcomes that can be adapted more readily to new information and changing public priorities.

“Keep your government hands off my Medicare!” Such comments spotlight a central question animating Suzanne Mettler’s provocative and timely book: why are many Americans unaware of government social benefits and so hostile to them in principle, even though they receive them? The Obama administration has been roundly criticized for its inability to convey how much it has accomplished for ordinary citizens. Mettler argues that this difficulty is not merely a failure of communication; rather it is endemic to the formidable presence of the “submerged state.”

In recent decades, federal policymakers have increasingly shunned the outright disbursing of benefits to individuals and families and favored instead less visible and more indirect incentives and subsidies, from tax breaks to payments for services to private companies. These submerged policies, Mettler shows, obscure the role of government and exaggerate that of the market. As a result, citizens are unaware not only of the benefits they receive, but of the massive advantages given to powerful interests, such as insurance companies and the financial industry. Neither do they realize that the policies of the submerged state shower their largest benefits on the most affluent Americans, exacerbating inequality. Mettler analyzes three Obama reforms—student aid, tax relief, and health care—to reveal the submerged state and its consequences, demonstrating how structurally difficult it is to enact policy reforms and even to obtain public recognition for achieving them. She concludes with recommendations for reform to help make hidden policies more visible and governance more comprehensible to all Americans.

The sad truth is that many American citizens do not know how major social programs work—or even whether they benefit from them. Suzanne Mettler’s important new book will bring government policies back to the surface and encourage citizens to reclaim their voice in the political process.

Critics claim that Supreme Court nominees have become more evasive in recent decades and that Senate confirmation hearings lack real substance. Conducting a line-by-line analysis of the confirmation hearing of every nominee since 1955—an original dataset of nearly 11,000 questions and answers from testimony before the Senate Judiciary Committee—Dion Farganis and Justin Wedeking discover that nominees are far more forthcoming than generally assumed. Applying an original scoring system to assess each nominee’s testimony based on the same criteria, they show that some of the earliest nominees were actually less willing to answer questions than their contemporary counterparts. Factors such as changes in the political culture of Congress and the 1981 introduction of televised coverage of the hearings have created the impression that nominee candor is in decline. Further, senators’ votes are driven more by party and ideology than by a nominee’s responsiveness to their questions. Moreover, changes in the confirmation process intersect with increasing levels of party polarization as well as constituents’ more informed awareness and opinions of recent Supreme Court nominees.

The three most important Supreme Court Justices before the Civil War—Chief Justices John Marshall and Roger B. Taney and Associate Justice Joseph Story—upheld the institution of slavery in ruling after ruling. These opinions cast a shadow over the Court and the legacies of these men, but historians have rarely delved deeply into the personal and political ideas and motivations they held. In Supreme Injustice, the distinguished legal historian Paul Finkelman establishes an authoritative account of each justice’s proslavery position, the reasoning behind his opposition to black freedom, and the incentives created by circumstances in his private life.

Finkelman uses census data and other sources to reveal that Justice Marshall aggressively bought and sold slaves throughout his lifetime—a fact that biographers have ignored. Justice Story never owned slaves and condemned slavery while riding circuit, and yet on the high court he remained silent on slave trade cases and ruled against blacks who sued for freedom. Although Justice Taney freed many of his own slaves, he zealously and consistently opposed black freedom, arguing in Dred Scott that free blacks had no Constitutional rights and that slave owners could move slaves into the Western territories. Finkelman situates this infamous holding within a solid record of support for slavery and hostility to free blacks.

Supreme Injustice boldly documents the entanglements that alienated three major justices from America’s founding ideals and embedded racism ever deeper in American civic life.

Even as unemployment rates soared during the Great Depression, FDR’s relief and social security programs faced attacks in Congress and the courts on the legitimacy of federal aid to the growing population of poor. In response, New Dealers pointed to a long tradition—dating back to 1790 and now largely forgotten—of federal aid to victims of disaster. In The Sympathetic State, Michele Landis Dauber recovers this crucial aspect of American history, tracing the roots of the modern American welfare state beyond the New Deal and the Progressive Era back to the earliest days of the republic when relief was forthcoming for the victims of wars, fires, floods, hurricanes, and earthquakes.
 
Drawing on a variety of materials, including newspapers, legal briefs, political speeches, the art and literature of the time, and letters from thousands of ordinary Americans, Dauber shows that while this long history of government disaster relief has faded from our memory today, it was extremely well known to advocates for an expanded role for the national government in the 1930s, including the Social Security Act. Making this connection required framing the Great Depression as a disaster afflicting citizens though no fault of their own. Dauber argues that the disaster paradigm, though successful in defending the New Deal, would ultimately come back to haunt advocates for social welfare. By not making a more radical case for relief, proponents of the New Deal helped create the weak, uniquely American welfare state we have today—one torn between the desire to come to the aid of those suffering and the deeply rooted suspicion that those in need are responsible for their own deprivation.
 
Contrary to conventional thought, the history of federal disaster relief is one of remarkable consistency, despite significant political and ideological change. Dauber’s pathbreaking and highly readable book uncovers the historical origins of the modern American welfare state.
