Latinos in the United States encompass a broad range of racial, socioeconomic, and sociopolitical identities. Originating from the Caribbean, Spain, Central and South America, and Mexico, they have unique justice concerns. The ethnic group includes U.S. citizens, authorized resident aliens, and undocumented aliens, a group that has been a constant partner in the Latino legal landscape for over a century. This book addresses the development and rapid growth of the Latino population in the United States and how race-based discrimination, hate crimes, and other prejudicial attitudes, some of which have been codified via public policy, have grown in response. Salinas explores the degrading practice of racial profiling, an approach used by both federal and state law enforcement agents; the abuse in immigration enforcement; and the use of deadly force against immigrants. The author also discusses the barriers Latinos encounter as they wend their way through the court system. While all minorities face the barrier of racially based jury strikes, bilingual Latinos deal with additional concerns, since limited-English-proficient defendants depend on interpreters to understand the trial process. As a nation rich in ethnic and racial backgrounds, the United States, Salinas argues, should better strive to serve its principles of justice.

The legal community traditionally has drawn unsystematically and at will on the findings of social science, sometimes with unfortunate results. The authors of this study explore this issue by focusing on the way the United States Supreme Court uses social science data in reaching its decisions. Concentrating on decisions involving abortion, sex discrimination, and sexual harassment, they show that the use of such data has increased over the last twenty years, but that the data's use by the court appears to hinge more on the judges' liberal, conservative, or long-held positions and the types of cases involved than on the objectivity or validity of the data.
     
By offering insights into how data are used by the Supreme Court, the authors hope to show social scientists how to make their research more suitable for courtroom use and to show the legal community how such data can be used more effectively. The volume includes an overview of the kinds of research used, a list of cases in which such research was used, and a discussion of justices and how they voted on cases in which such data were used from 1972 to 1992.

Partly because its colonial settlements were tiny, remote, and inconsequential, the early history of Arkansas has been almost entirely neglected. Even Arkansas Post, the principal eighteenth-century settlement, served mainly as a temporary place of residence for trappers and voyageurs. It was also an entrepot for travelers on the Mississippi—a place to be while on the way elsewhere. Only a very few inhabitants, true agricultural settlers, ever established themselves a or around the Post.

For most of the eighteenth century, Arkansas’s non-Indian population was less than one hundred, and never much exceeded five or six hundred. Its European residents of that era, mostly French, have left virtually no physical trace: the oldest buildings and the oldest marked graves in the state date from the 1820s. Drawing on original French and Spanish archival sources, Morris Arnold chronicles for the first time the legal institutions of colonial Arkansas, the attitude of its population towards European legal ideas as were current in Arkansas when Louisiana was transferred to the United States in 1803. Because he views the clash of legal traditions in the upper reaches of the Jefferson’s Louisiana as part of a more general cultural conflict, Arnold closely examines the social and economic characteristics of Arkansas’s early residents in order to explain why, following the American takeover, the common law was introduced into Arkansas with such relative ease.

The book begins with statehood and continues with Congress’s decision to expand jurisdiction of the original 1836 District Court of Arkansas to include the vast Indian Territory to the west. The territory’s formidable size and rampant lawlessness brought in an overwhelming number of cases. The situation was only somewhat mitigated in 1851, when Congress split the state into eastern and western districts, which were still served by just one judge who travelled between the two courts.

A new judgeship for the Western District was created in 1871, and new seats for that court were established, but it wasn’t until 1896 that Congress finally ended all jurisdiction of Arkansas’s Western District Court over the Indian Territory.

Contributors to this collection include judges, practicing attorneys, academics, and thoughtful and informed family members who reveal how the judges made decisions on issues involving election laws, taxes, civil rights, railroads, liquor and prohibition, quack medicine, gangsters, bankruptcy, personal injury, the draft and Selective Service, school desegregation, prisons, and more. United States District Courts and Judges of Arkansas, 1836–1960 will be of value to anyone interested in Arkansas history—particularly Arkansas legal and judicial history as it relates to the local and national issues that came before these judges.

The Catholic Church of early modern Europe intended the sacrament of matrimony to represent a lifelong commitment, and it allowed few grounds for the dissolution of an unhappy marriage. One was nonconsummation owing to the sexual impotency of one of the partners. Even then, an annulment was granted only after a church court had conducted a lengthy investigation of the case, soliciting testimony from numerous witnesses as well as from the aggrieved couple, and had subjected the allegedly impotent spouse (and sometimes both spouses) to an intimate physical examination.

Edward J. Behrend-Martinez has studied the transcripts of eighty-three impotency trials conducted by the ecclesiastical court of Calahorra (La Rioja), a Spanish diocese with urban and rural parishes, both Basque and Castilian. From these records, he draws a detailed, fascinating portrait of private life and public sexuality in early modern Europe. These trials were far more than a salacious inquiry into the intimate details of other people’s lives. The church valued marital sex as a cornerstone of stable society, intended not only for procreation but also for maintaining domestic harmony. Every couple’s sex life, however private in practice or intention, was a matter of public and ecclesiastical concern. Unfit for Marriage offers vivid accounts of marital sex and the role that property, gender, and personal preference played in marriage in early modern Europe. What do universal rights to public goods like education mean when codified as individual, private choices? Is the “problem” of school choice actually not about better choices for all but, rather, about the competition and exclusion that choice engenders—guaranteeing a system of winners and losers? Unsettling Choice addresses such questions through a compelling ethnography that illuminates how one path of neoliberal restructuring in the United States emerged in tandem with, and in response to, the Civil Rights movement.

 

Drawing on ethnographic research in one New York City school district, Unsettling Choice traces the contestations that surfaced when, in the wake of the 2007–2009 Great Recession, public schools navigated austerity by expanding choice-based programs. Ujju Aggarwal argues that this strategy, positioned as “saving public schools,” mobilized mechanisms rooted in market logics to recruit families with economic capital on their side, thereby solidifying a public sphere that increasingly resembled the private—where contingency was anticipated and rights for some were marked by intensified precarity for poor and working-class Black and Latinx families.

 

As Unsettling Choice shows, these struggles over public schools—one of the last remaining universal public goods in the United States—were entrapped within neoliberal regimes that exceeded privatization and ensured exclusion even as they were couched in language of equity, diversity, care, and rights. And yet this richly detailed and engaging book also tracks an architecture of expansive rights, care, and belonging built among poor and working-class parents at a Head Start center, whose critique of choice helps us understand how we might struggle for—and reimagine—justice, and a public that remains to be won.

It is no longer clear what role the University plays in society. The structure of the contemporary University is changing rapidly, and we have yet to understand what precisely these changes will mean. Is a new age dawning for the University, the renaissance of higher education under way? Or is the University in the twilight of its social function, the demise of higher education fast approaching?We can answer such questions only if we look carefully at the different roles the University has played historically and then imagine how it might be possible to live, and to think, amid the ruins of the University. Tracing the roots of the modern American University in German philosophy and in the work of British thinkers such as Newman and Arnold, Bill Readings argues that historically the integrity of the modern University has been linked to the nation-state, which it has served by promoting and protecting the idea of a national culture. But now the nation-state is in decline, and national culture no longer needs to be either promoted or protected. Increasingly, universities are turning into transnational corporations, and the idea of culture is being replaced by the discourse of "excellence." On the surface, this does not seem particularly pernicious.

The author cautions, however, that we should not embrace this techno-bureaucratic appeal too quickly. The new University of Excellence is a corporation driven by market forces, and, as such, is more interested in profit margins than in thought. Readings urges us to imagine how to think, without concession to corporate excellence or recourse to romantic nostalgia within an institution in ruins. The result is a passionate appeal for a new community of thinkers.

Revisiting this pivotal era in the history of the American state university, Scott Gelber demonstrates that Populists expressed a surprising degree of enthusiasm for institutions of higher learning. More fundamentally, he argues that the mission of the state university, as we understand it today, evolved from a fractious but productive relationship between public demands and academic authority.
    Populists attacked a variety of elites—professionals, executives, scholars—and seemed to confirm academia’s fear of anti-intellectual public oversight. The movement’s vision of the state university highlighted deep tensions in American attitudes toward meritocracy and expertise. Yet Populists also promoted state-supported higher education, with the aims of educating the sons (and sometimes daughters) of ordinary citizens, blurring status distinctions, and promoting civic engagement. Accessibility, utilitarianism, and public service were the bywords of Populist journalists, legislators, trustees, and sympathetic professors. These “academic populists” encouraged state universities to reckon with egalitarian perspectives on admissions, financial aid, curricula, and research. And despite their critiques of college “ivory towers,” Populists supported the humanities and social sciences, tolerated a degree of ideological dissent, and lobbied for record-breaking appropriations for state institutions.

He considers the differences between self-rule and specialized expertise and provides a case study of a New York City public school to show how kids and families respond to the demands of managerial productivity that is part of preparing students for college. Under New Management also considers changes faced by students, faculty, and administrators in light of this reworked social compact of professionals.

U.S.-China relations became increasingly important and complex in the twentieth century. While economic, political, and military interactions all grew over time, the most dramatic expansion took place in educational exchange, turning it into the strongest tie between the two nations. By the end of the 1940s, tens of thousands of Chinese and American students and scholars had crisscrossed the Pacific, leaving indelible marks on both societies. Although all exchange programs were terminated during the cold war, the two nations reemerged as top partners within a decade after the reestablishment of diplomatic relations.

            Approaching U.S.-China relations from a unique and usually overlooked perspective, Hongshan Li reveals that both the drastic expansion and complete termination of educational ties between the two nations in the first half of the twentieth century were largely the results of direct and deep intervention from the American and Chinese governments. Benefiting from government support and collaboration, educational exchange succeeded in diffusing knowledge and improving mutual understanding between the two peoples across the divide of civilizations. However, the visible hand of government also proved to be most destructive to the development of healthy intercultural relations when educational interactions were treated merely as an instrument for crisis management.

For decades, leaders in higher education have voiced their intention to expand college education to include disadvantaged groups. Colleges have embraced and defended public policies that push back against discrimination and make college more affordable. And yet, as the economist Charles Clotfelter shows, America’s system of undergraduate education was unequal in 1970 and is even more so today.

In Unequal Colleges in the Age of Disparity, Clotfelter presents quantitative comparisons across selective and less selective colleges from the 1970s to the present, in exploration of three themes: diversity, competition, and inequality. Diversity shows itself in the variety of colleges’ objectives but also in the disparity of the material and human resources at their disposal. Competition operates through both the supply and the demand sides of the market, with college admissions becoming more meritocratic even as the most desirable colleges choose to contend fiercely for top-tier students rather than accommodate rising numbers of qualified applicants. Clotfelter shows that exclusive colleges have also benefited disproportionately from America’s growing income inequality. As their endowments have ballooned, their students have become more academically advantaged, owing in part to the extraordinary steps affluent families take to groom their children for college admission.

Clotfelter finds that despite a revolution in civil rights, billions spent on financial aid, and the commitment of colleges to greater equality, stratification has grown starker. Top colleges cater largely to children of elites.

Since World War II, says the author, industrialized nations have come to depend so heavily on expert knowledge, scientific discovery, and highly trained personnel that universities have become “the central institution in postindustrial society.”
“If universities are so important to society and if ours are so superior, one might have thought that America would be flourishing in comparison to other industrialized countries of the world. Yet this is plainly not the case. . . . Our economic position in the world has deteriorated [and] we have climbed to the top, or near the top, of all advanced countries in the percentage of population who live in poverty, commit crimes, become addicted to drugs, have illegitimate children, or are classified as functionally illiterate.” In light of these results, “it is fair to ask whether our universities are doing all they can and should to help America surmount the obstacles that sap our economic strength and blight the lives of millions of our people.”
Having posed this question, Derek Bok reviews what science can do to bring about greater productivity, what professional schools can do to improve the effectiveness of corporations, government, and public education, and what all parts of the university are doing to help students acquire higher levels of ethical and social responsibility. He concludes that Universities are contributing much less than the should to help the nation address its most urgent social problems. “A century after the death of Cardinal Newman, many university officials and faculty members continue to feel ambivalent about deliberate efforts to address practical problems of society. And though competition drives university leaders and their faculties to unremitting effort, what competition rewards is chiefly success in fields that command academic prestige rather than success in responding to important social needs.”
Bok urges academic leaders, trustees, foundations, and government agencies to work together to help universities realign their priorities “so that they will be ready to make their full contribution when the nation turns its attention again to the broad agenda of reform. . . . Observing our difficulties competing abroad, our millions of people in poverty, our drug-ridden communities, our disintegrating families, our ineffective schools, those who help to shape our universities have reason to ask whether they too have any time to lose.”

How will this reversal of minority status affect ideas about race? In spaces dominated by people of color, will attitudes about white privilege change? Or, will deeply rooted beliefs about racial inequality be resilient to numerical shifts in strength?

In An Unexpected Minority, sociologist Edward Morris addresses these far-reaching questions by exploring attitudes about white identity in a Texas middle school composed predominantly of African Americans, Latinos, and Asians. Based on his ethnographic research, Morris argues that lower-income white students in urban schools do not necessarily maintain the sort of white privilege documented in other settings. Within the student body, African American students were more frequently the "cool" kids, and white students adopted elements of black culture-including dress, hairstyle, and language-to gain acceptance. Morris observes, however, that racial inequalities were not always reversed. Stereotypes that cast white students as better behaved and more academically gifted were often reinforced, even by African American teachers.

Providing a new and timely perspective to the significant role that non-whites play in the construction of attitudes about whiteness, this book takes an important step in advancing the discussion of racial inequality and its future in this country.

In the fall of 1957, Gov. Orval Faubus used the Arkansas National Guard to prohibit nine black children from entering Little Rock's Central High School. In the fall of 1997, the "Little Rock Nine" returned to Central High, this time escorted by President Bill Clinton. In the forty years that had intervened, the United States witnessed substantial changes in American race relations, but the city of Little Rock had not overcome its legacy of strife. The two-year crisis, once over, left behind confusion and misunderstanding. Racial and class-based mistrust lingers in the city of Little Rock, and, nationally and internationally, perceptions of Arkansas are still tied to the decades-old images of hatred and strife that marked the Little Rock crisis. In 1997, the University of Arkansas at Little Rock sponsored a gathering of scholars who traced the origins and addressed the legacy of the Central High crisis. Elizabeth Jacoway and C. Fred Williams commissioned a series of original and insightful papers that discussed economic, constitutional, historical, and personal aspects of the crisis and of segregation. Higher education hails Asian American students as model minorities who face no educational barriers given their purported cultural values of hard work and political passivity. Described as “over-represented,” Asian Americans have been overlooked in discussions about diversity; however, racial hostility continues to affect Asian American students, and they have actively challenged their invisibility in minority student discussions. This study details the history of Asian American student activism at the University of Illinois Urbana-Champaign, as students rejected the university’s definition of minority student needs that relied on a model minority myth, measures of under-representation, and a Black-White racial model, concepts that made them an “unseen unheard minority.” This activism led to the creation on campus of one of the largest Asian American Studies programs and Asian American cultural centers in the Midwest. Their histories reveal the limitations of understanding minority student needs solely along measures of under-representation and the realities of race for Asian American college students.

The Unteachables examines the overrepresentation of Black students in special education over the course of the twentieth century. As African American children integrated predominantly white schools, many were disproportionately labeled educable mentally retarded (EMR), learning disabled (LD), and emotionally behavioral disordered (EBD). Keith A. Mayes charts the evolution of disability categories and how these labels kept Black learners segregated in American classrooms.

The civil rights and the educational disability rights movements, Mayes shows, have both collaborated and worked at cross-purposes since the beginning of school desegregation. Disability rights advocates built upon the opportunity provided by the civil rights movement to make claims about student invisibility at the level of intellectual and cognitive disabilities. Although special education ostensibly included children from all racial groups, educational disability rights advocates focused on the needs of white disabled students, while school systems used disability discourses to malign and marginalize Black students.

From the 1940s to the present, social science researchers, policymakers, school administrators, and teachers have each contributed to the overrepresentation of Black students in special education. Excavating the deep-seated racism embedded in both the public school system and public policy, The Unteachables explores the discriminatory labeling of Black students, and how it indelibly contributed to special education disproportionality, to student discipline and push-out practices, and to the school-to-prison pipeline effect.

Chicago has long struggled with racial residential segregation, high rates of poverty, and deepening class stratification, and it can be a challenging place for adolescents to grow up. Unequal City examines the ways in which Chicago’s most vulnerable residents navigate their neighborhoods, life opportunities, and encounters with the law. In this pioneering analysis of the intersection of race, place, and opportunity, sociologist and criminal justice expert Carla Shedd illuminates how schools either reinforce or ameliorate the social inequalities that shape the worlds of these adolescents.

Shedd draws from an array of data and in-depth interviews with Chicago youth to offer new insight into this understudied group. Focusing on four public high schools with differing student bodies, Shedd reveals how the predominantly low-income African American students at one school encounter obstacles their more affluent, white counterparts on the other side of the city do not face. Teens often travel long distances to attend school which, due to Chicago’s segregated and highly unequal neighborhoods, can involve crossing class, race, and gang lines. As Shedd explains, the disadvantaged teens who traverse these boundaries daily develop a keen “perception of injustice,” or the recognition that their economic and educational opportunities are restricted by their place in the social hierarchy.

Adolescents’ worldviews are also influenced by encounters with law enforcement while traveling to school and during school hours. Shedd tracks the rise of metal detectors, surveillance cameras, and pat-downs at certain Chicago schools. Along with police procedures like stop-and-frisk, these prison-like practices lead to distrust of authority and feelings of powerlessness among the adolescents who experience mistreatment either firsthand or vicariously. Shedd finds that the racial composition of the student body profoundly shapes students’ perceptions of injustice. The more diverse a school is, the more likely its students of color will recognize whether they are subject to discriminatory treatment. By contrast, African American and Hispanic youth whose schools and neighborhoods are both highly segregated and highly policed are less likely to understand their individual and group disadvantage due to their lack of exposure to youth of differing backgrounds.

As Padilla demonstrates, the popular longings that drove the Mexican Revolution permeated these schools. Over the coming decades, the tensions between state consolidation and revolutionary justice produced a telling contradiction: the very schools meant to constitute a loyal citizenry became hubs of radicalization against a government that increasingly abandoned its commitment to social justice. The years 1894 to 1904 mark the stormy tenure of Andrew S. Draper as president of the University of Illinois. Draper, a successful superintendent of schools with no college or university experience and no credentials as a post-secondary administrator, presided over many crucial improvements in the university's physical plant, curricula, and other areas. However, he failed to infuse the university with a spirit of cohesion, and his term as president was fraught with conflict.
From his inauguration on, the autocratic Draper collided with deans and faculty who opposed both the substance of his changes and the manner in which he presented and implemented them.
 
This volume closely examines the Draper years from the perspectives of faculty, students, and administrators. Solberg outlines the administrative, faculty, staff, and physical infrastructure. He also reveals a vibrant and varied student life, including a whirl of social activities, literary societies, intercollegiate debate and athletics, hazing, religion, and increasingly prominent fraternities.

With an uncertain beginning in the sparsely populated remote northern Nevada town of Elko, a preparatory school opened its doors in October 1874 through the Morrill Act that sought to establish land-grant universities across the nation. Seven students began their higher education experience with dreams of a better future, but they probably could not have predicted that their alma mater would one day become the University of Nevada, Reno, a nationally classified Carnegie R1 “Very High Research” institution.

As both the University’s student body and the state’s population grew, the campus was transferred to Reno in 1885-86 as an effort to secure the fledgling institution’s prospects for survival. Many of the initial class of thirty-five students resided in Morrill Hall, the only building on campus, where they also received instruction and ate their meals. As the University enhanced its academic offerings, enrollment grew to more than 1,000 students by the turn of the century. A strong belief that the University must always be changing and evolving to meet the needs of its students and answer the challenges of a particular era became the guiding forces behind the administration’s decision-making. With an increasingly diverse student body and one of the most productive academic faculties in the country, the little school on the hill expanded during its first 100 years to become a leading public university in the western United States.

Today, the University continues to achieve institutional benchmarks, including a record 5,000 graduates during the 2019–20 academic year. It is exactly this kind of student success that has always been at the heart of the Wolf Pack Family’s mission to help students find the path that is right for them, and beckon others to share in their journey.

Undercurrents recounts the life and career of John Byrne, who started as a geologist at an oil company and retired as president of a major land grant university. He came to Oregon State in 1960 as a faculty member, later becoming department chair, dean, director of the Hatfield Marine Science Center, and vice president for Research and Graduate Studies. Along the way, he took leave from the university to serve the US government, first as a program director for oceanography at the National Science Foundation, and later as the administrator of the National Oceanic and Atmospheric Administration, before returning to OSU in 1984 as its twelfth president.

As president of OSU, John Byrne used the lessons learned in industry and government to guide the university through a period of turbulence caused by severe state budget restrictions. During this period of economic contraction, OSU continued under Byrne’s leadership to grow in programs, facilities, and external funding. Byrne was one of the first to introduce Total Quality Management techniques to higher education. He emphasized the importance of international education and was a supporter of significant academic reform in higher education.

While focusing on his professional career, Byrne’s memoir also shares personal stories of a childhood and youth shaped by the Great Depression and World War II. Undercurrents demonstrates on every page the curiosity, intellect, and humanity that made John Byrne successful as a scientist, educator, and administrator. Anyone pursuing a career in science or academia, and anyone interested in the history and legacy of land grant universities will welcome this richly detailed and warmly written account of Byrne’s career.

Well into the new millennium, the analog cassette tape continues to claw its way back from obsolescence. New cassette labels emerge from hipster enclaves while the cassette’s likeness pops up on T-shirts, coffee mugs, belt buckles, and cell phone cases. In Unspooled, Rob Drew traces how a lowly, hissy format that began life in office dictation machines and cheap portable players came to be regarded as a token of intimate expression through music and a source of cultural capital. Drawing on sources ranging from obscure music zines to transcripts of Congressional hearings, Drew examines a moment in the early 1980s when music industry representatives argued that the cassette encouraged piracy. At the same time, 1980s indie rock culture used the cassette as a symbol to define itself as an outsider community. Indie’s love affair with the cassette culminated in the mixtape, which advanced indie’s image as a gift economy. By telling the cassette’s long and winding history, Drew demonstrates that sharing cassettes became an acceptable and meaningful mode of communication that initiated rituals of independent music recording, re-recording, and gifting.

In Unfree Masters Matt Stahl examines recording artists' labor in the music industry as a form of creative work. He begins by considering the television show American Idol and the 2004 rockumentary Dig!, tracing the ways that popular music making is narrativized in contemporary America and showing how such narratives highlight musicians' negotiations of the limits of freedom and autonomy in creative cultural-industrial work. Turning to struggles between recording artists and record companies over laws that govern their working and contractual relationships, he reveals further tensions and contradictions in this form of work. Stahl argues that media narratives of music making, as well as contract and copyright disputes between musicians and music industry executives, contribute to American socioeconomic discourse and expose a foundational tension between democratic principles of individual autonomy and responsibility and the power of employers to control labor and appropriate its products. Stahl asserts that the labor issues that he discloses in music can stimulate insights about the political-economic and imaginative challenges currently facing working people of all kinds.

An in-depth account of the Black locals within the American Federation of Musicians

In the 1910s and 1920s, Black musicians organized more than fifty independent locals within the American Federation of Musicians (AFM) in an attempt to control audition criteria, set competitive wages, and secure a voice in national decision-making. Leta Miller follows the AFM’s history of Black locals, which competed directly with white locals in the same territories, from their origins and successes in the 1920s through Depression-era crises to the fraught process of dismantling segregated AFM organizations in the 1960s and 70s. Like any union, Black AFM locals sought to ensure employment and competitive wages for members with always-evolving solutions to problems. Miller’s account of these efforts includes the voices of the musicians themselves and interviews with former union members who took part in the difficult integration of Black and white locals. She also analyzes the fundamental question of how musicians benefitted from membership in a labor organization.

Broad in scope and rich in detail, Union Divided illuminates the complex working world of unionized Black musicians and the AFM’s journey to racial inclusion.

From its dissonant musics to its surrealist spectacles (the urinal is a violin!), Modernist art often seems to give more frustration than pleasure to its audience. In Untwisting the Serpent, Daniel Albright shows that this perception arises partly because we usually consider each art form in isolation, even though many of the most important artistic experiments of the Modernists were collaborations involving several media—Igor Stravinsky's The Rite of Spring is a ballet, Gertrude Stein's Four Saints in Three Acts is an opera, and Pablo Picasso turned his cubist paintings into costumes for Parade.

Focusing on collaborations with a musical component, Albright views these works as either figures of dissonance that try to retain the distinctness of their various media (e.g. Guillaume Apollinaire's Les Mamelles de Tirésias) or figures of consonance that try to lose themselves in some total effect (e.g. Arnold Schoenberg's Erwartung). In so doing he offers a fresh picture of Modernism, and provides a compelling model for the analysis of all artistic collaborations.

Untwisting the Serpent is the recipient of the 2001 Susanne M. Glasscock Humanities Book Prize for Interdisciplinary Scholarship of the Center for Humanities Research at Texas A&M University.

An Unnatural Attitude traces a style of musical thought that coalesced in the intellectual milieu of the Weimar Republic—a phenomenological style that sought to renew contact with music as a worldly circumstance. Deeply critical of the influence of naturalism in aesthetics and ethics, proponents of this new style argued for the description of music as something accessible neither through introspection nor through experimental research, but rather in an attitude of outward, open orientation toward the world. With this approach, music acquires meaning in particular when the act of listening is understood to be shared with others.
 
Benjamin Steege interprets this discourse as the response of a young, post–World War I generation amid a virtually uninterrupted experience of war, actual or imminent—a cohort for whom disenchantment with scientific achievement was to be answered by reasserting the value of imaginative thought. Steege draws on a wide range of published and unpublished texts from music theory, pedagogy, criticism, and philosophy of music, some of which appear for the first time in English translation in the book’s appendixes. An Unnatural Attitude considers the question: What are we thinking about when we think about music in non-naturalistic terms?

These talks, written and delivered when Leonard Bernstein was Charles Eliot Norton Professor of Poetry at Harvard University, are the newest of the author’s literary achievements. In addition to a distinguished career as conductor, pianist, and composer, Mr. Bernstein is the recipient of many television Emmys for the scripts of his Young People’s Concerts, Omnibus programs, and others, and is the author of The Infinite Variety of Music and The Joy of Music, for which he received the Christopher Award.

Countering standard formulations of diaspora that inevitably foreground the nation-state, as well as familiar formulations of queerness that ignore regional gender and sexual formations, she stages unexpected encounters between works by South Asian, Middle Eastern, African, Australian, and Latinx artists such as Tracey Moffatt, Akram Zaatari, and Allan deSouza. Gopinath shows how their art functions as regional queer archives that express alternative understandings of time, space, and relationality. The queer optics produced by these visual practices creates South-to-South, region-to-region, and diaspora-to-region cartographies that profoundly challenge disciplinary and area studies rubrics. Gopinath thereby provides new critical perspectives on settler colonialism, empire, military occupation, racialization, and diasporic dislocation as they indelibly mark both bodies and landscapes.

American art of the 1980s is as misunderstood as it is notorious. Critics of the time feared that market hype and self-promotion threatened the integrity of art. They lashed out at contemporary art, questioning the validity of particular media and methods and dividing the art into opposing camps. While controversies have since subsided, critics still view art of the 1980s as a stylistic battlefield. Alison Pearlman rejects this picture, which is truer of the period's criticism than of its art.

Pearlman reassesses the works and careers of six artists who became critics' biggest targets. In each of three chapters, she pairs two artists the critics viewed as emblematic of a given trend: Julian Schnabel and David Salle in association with Neo-Expressionism; Jean-Michel Basquiat and Keith Haring vis-à-vis Graffiti Art; and Peter Halley and Jeff Koons in relation to Simulationism. Pearlman shows how all these artists shared important but unrecognized influences and approaches: a crucial and overwhelming inheritance of 1960s and 1970s Conceptualism, a Warholian understanding of public identity, and a deliberate and nuanced use of past styles and media. Through in-depth discussions of works, from Haring's body-paintings of Grace Jones to Schnabel's movie Basquiat, Pearlman demonstrates how these artists' interests exemplified a broader, generational shift unrecognized by critics. She sees this shift as starting not in the 1980s but in the mid-1970s, when key developments in artistic style, art-world structures, and consumer culture converged to radically alter the course of American art.

Unpackaging Art of the 1980s offers an innovative approach to one of the most significant yet least understood episodes in twentieth-century art.

Machida focuses on works produced during the watershed 1990s, when surging Asian immigration had significantly altered the demographic, cultural, and political contours of Asian America, and a renaissance in Asian American art and visual culture was well underway. Machida conducted extensive interviews with ten artists working during this transformative period: women and men of Chinese, Filipino, Indian, Vietnamese, Korean, and Japanese descent, most of whom migrated to the United States. In dialogue with the artists, Machida illuminates and contextualizes the origins of and intent behind bodies of their work. Unsettled Visions is an engrossing look at a vital art scene and a subtle account of the multiple, shifting meanings of “Asianness” in Asian American art.

Analyses of the work of individual artists are grouped around three major themes that Asian American artists engaged with during the 1990s: representations of the Other; social memory and trauma; and migration, diaspora, and sense of place. Machida considers the work of the photographers Pipo Nguyen-duy and Hanh Thi Pham, the printmaker and sculptor Zarina Hashmi, and installations by the artists Tomie Arai, Ming Fay, and Yong Soon Min. She examines the work of Marlon Fuentes, whose films and photographs play with the stereotyping conventions of visual anthropology, and prints in which Allan deSouza addresses the persistence of Orientalism in American popular culture. Machida reflects on Kristine Aono’s museum installations embodying the multigenerational effects of the internment of Japanese Americans during World War II and on Y. David Chung’s representations of urban spaces transformed by migration in works ranging from large-scale charcoal drawings to multimedia installations and an “electronic rap opera.”

Much of today’s discussion has turned to the recovery of modernity, but Martin writes in the Introduction, “Simply to historicize postmodernism seems inadequate and, in many ways, premature.” Utopia’s Ghost connects architecture to current debates on biopolitics, neoliberalism, and corporate globalization as they are haunted by the problem of utopia. Exploring a series of concepts—territory, history, language, image, materiality, subjectivity, and architecture itself—Martin shows how they reorganize the cultural imaginary and shape a contemporary biopolitics that ultimately precludes utopian thought.

With Up Against the Real, Nadja Millner-Larsen offers the first comprehensive study of the group Black Mask and its acrimonious relationship to the New York art world of the 1960s. Cited as pioneers of now-common protest aesthetics, the group’s members employed incendiary modes of direct action against racism, colonialism, and the museum system. They shut down the Museum of Modern Art, fired blanks during a poetry reading, stormed the Pentagon in an antiwar protest, sprayed cow’s blood at the secretary of state, and dumped garbage into the fountain at Lincoln Center. Black Mask published a Dadaist broadside until 1968, when it changed its name to Up Against the Wall Motherfucker (after line in a poem by Amiri Baraka) and came to classify itself as “a street gang with analysis.” American activist Abbie Hoffman described the group as “the middle-class nightmare . . . an anti-media phenomenon simply because their name could not be printed.”
 
Up Against the Real examines how and why the group ultimately rejected art in favor of what its members deemed “real” political action. Exploring this notorious example of cultural activism that rose from the ruins of the avant-garde, Millner-Larsen makes a critical intervention in our understanding of political art.

They propose various legal strategies, curatorial practices, and standards of doing business intended to serve the public interest in the arts.

An ethnography of the decolonization of Maya-ness.

On the Yucatán Peninsula today, undergraduates are inventing a new sense of being Maya by studying linguistics and culture in their own language: Maya. In this bold theoretical intervention informed by ethnographic research, Catherine R. Rhodes argues that these students are undoing the category of modernity itself. Created through colonization of the Americas, modernity is the counterpart to coloniality; the students, Rhodes suggests, are creating decoloniality’s companion: “demodernity.”

Disciplines like linguistics, anthropology, history, and archaeology invented “the Maya” as an essentialized ethnos in a colonial, modern mold. Undoing Modernity follows students and their teachers as they upset the seemingly stable ethnic definition of Maya, with its reliance on a firm dichotomy of Maya and modern. Maya linguistics does not prove that Maya is modern but instead rejects the Maya-ness that modernity built, while also fostering within the university an intellectual space in which students articulate identity on their own terms. An erudite and ultimately hopeful work of interdisciplinary scholarship that brings linguistic anthropology, Mesoamerican studies, and critical Indigenous studies into the conversation, Undoing Modernity dares to imagine the world on the other side of colonial/modern ideals of Indigeneity.

By analyzing how various media told stories about Jewish celebrities and incest, Unsettling illustrates how Jewish community protective politics impacted the representation of white male Jewish masculinity in the 1990s. Chapters on Woody Allen, Roseanne Barr, and Henry Roth demonstrate how media coverage of their respective incest denials (Allen), allegations (Barr), and confessions (Roth) intersect with a history of sexual antisemitism, while an introductory chapter on Jewish second-wave feminist criticism of Sigmund Freud considers how Freud became “white” in these discussions. Unsettling reveals how film, TV, and literature have helped displace once prevalent antisemitic stereotypes onto those who are non-Jewish, nonwhite, and poor. In considering how whiteness functions for an ethnoreligious group with historic vulnerability to incest stereotype as well as contemporary white privilege, Unsettling demonstrates how white Jewish men accused of incest, and even those who defiantly confess it, became improbably sympathetic figures representing supposed white male vulnerability.

This book mounts a sustained attack on ideas that are dear to many practitioners of analytic philosophy. Charles Travis targets the seductive illusion that—in Wittgenstein’s terms—“if anyone utters a sentence and means or understands it, he is operating a calculus according to definite rules.” This book rejects the idea that thoughts are essentially representational items whose content is independent of context. In doing so, it undermines the foundations of much contemporary philosophy of mind.

Travis’s main argument in Unshadowed Thought is that linguistic expressions and forms are occasion-sensitive; they cannot be abstracted out of a concrete context. With compelling examples and a thoroughgoing scrutiny of opposing positions, his book systematically works out the implications of the work of J. L. Austin, Hilary Putnam, and John McDowell. Eloquently insisting that there is no particular way one must structure what one relates to, no one way one must represent it, Unshadowed Thought identifies and resists a certain strain of semantic Platonism that permeates current philosophy—a strain that has had profoundly troubling consequences for our ideas about attitudes and beliefs and for our views about what language might be.
