Our laws provide comprehensive protection for property rights, labor, and other important interests, but sexual autonomy—the right to choose freely whether and when to be sexually intimate with another person—is devalued and ignored. With vivid examples, including stranger assaults, date rapes, and sexual encounters between job supervisors and subordinates, teachers and students, doctors and patients, lawyers and clients, Schulhofer shows that recent reforms of rape and sexual harassment law are overrated and inadequate. From the excessive degree of force necessary for an aggressive action to be defined as rape, to the gray areas in which coercion and exploitation can be used to elicit a false but legally valid “consent,” Schulhofer offers a clear analysis of the limits of current standards. His proposals for a radically different approach hold the promise of genuine respect and effective protection for the sexual autonomy of both women and men. It is an ambitious yet sensible vision, committed to allowing willing partners to seek consensual relationships, while fully protecting each person’s right to refuse sexual encounters that are not genuinely desired.
Partly because its colonial settlements were tiny, remote, and inconsequential, the early history of Arkansas has been almost entirely neglected. Even Arkansas Post, the principal eighteenth-century settlement, served mainly as a temporary place of residence for trappers and voyageurs. It was also an entrepot for travelers on the Mississippi—a place to be while on the way elsewhere. Only a very few inhabitants, true agricultural settlers, ever established themselves a or around the Post.
For most of the eighteenth century, Arkansas’s non-Indian population was less than one hundred, and never much exceeded five or six hundred. Its European residents of that era, mostly French, have left virtually no physical trace: the oldest buildings and the oldest marked graves in the state date from the 1820s. Drawing on original French and Spanish archival sources, Morris Arnold chronicles for the first time the legal institutions of colonial Arkansas, the attitude of its population towards European legal ideas as were current in Arkansas when Louisiana was transferred to the United States in 1803. Because he views the clash of legal traditions in the upper reaches of the Jefferson’s Louisiana as part of a more general cultural conflict, Arnold closely examines the social and economic characteristics of Arkansas’s early residents in order to explain why, following the American takeover, the common law was introduced into Arkansas with such relative ease.
The Catholic Church of early modern Europe intended the sacrament of matrimony to represent a lifelong commitment, and it allowed few grounds for the dissolution of an unhappy marriage. One was nonconsummation owing to the sexual impotency of one of the partners. Even then, an annulment was granted only after a church court had conducted a lengthy investigation of the case, soliciting testimony from numerous witnesses as well as from the aggrieved couple, and had subjected the allegedly impotent spouse (and sometimes both spouses) to an intimate physical examination.
Edward J. Behrend-Martinez has studied the transcripts of eighty-three impotency trials conducted by the ecclesiastical court of Calahorra (La Rioja), a Spanish diocese with urban and rural parishes, both Basque and Castilian. From these records, he draws a detailed, fascinating portrait of private life and public sexuality in early modern Europe. These trials were far more than a salacious inquiry into the intimate details of other people’s lives. The church valued marital sex as a cornerstone of stable society, intended not only for procreation but also for maintaining domestic harmony. Every couple’s sex life, however private in practice or intention, was a matter of public and ecclesiastical concern. Unfit for Marriage offers vivid accounts of marital sex and the role that property, gender, and personal preference played in marriage in early modern Europe. It is essential reading for anyone interested in social history, sexuality, gender studies, canon law, legal history, and the history of divorce in western Europe.
How the Great Recession revealed a system of school choice built on crisis, precarity, and exclusion
What do universal rights to public goods like education mean when codified as individual, private choices? Is the “problem” of school choice actually not about better choices for all but, rather, about the competition and exclusion that choice engenders—guaranteeing a system of winners and losers? Unsettling Choice addresses such questions through a compelling ethnography that illuminates how one path of neoliberal restructuring in the United States emerged in tandem with, and in response to, the Civil Rights movement.
Drawing on ethnographic research in one New York City school district, Unsettling Choice traces the contestations that surfaced when, in the wake of the 2007–2009 Great Recession, public schools navigated austerity by expanding choice-based programs. Ujju Aggarwal argues that this strategy, positioned as “saving public schools,” mobilized mechanisms rooted in market logics to recruit families with economic capital on their side, thereby solidifying a public sphere that increasingly resembled the private—where contingency was anticipated and rights for some were marked by intensified precarity for poor and working-class Black and Latinx families.
As Unsettling Choice shows, these struggles over public schools—one of the last remaining universal public goods in the United States—were entrapped within neoliberal regimes that exceeded privatization and ensured exclusion even as they were couched in language of equity, diversity, care, and rights. And yet this richly detailed and engaging book also tracks an architecture of expansive rights, care, and belonging built among poor and working-class parents at a Head Start center, whose critique of choice helps us understand how we might struggle for—and reimagine—justice, and a public that remains to be won.

It is no longer clear what role the University plays in society. The structure of the contemporary University is changing rapidly, and we have yet to understand what precisely these changes will mean. Is a new age dawning for the University, the renaissance of higher education under way? Or is the University in the twilight of its social function, the demise of higher education fast approaching?We can answer such questions only if we look carefully at the different roles the University has played historically and then imagine how it might be possible to live, and to think, amid the ruins of the University. Tracing the roots of the modern American University in German philosophy and in the work of British thinkers such as Newman and Arnold, Bill Readings argues that historically the integrity of the modern University has been linked to the nation-state, which it has served by promoting and protecting the idea of a national culture. But now the nation-state is in decline, and national culture no longer needs to be either promoted or protected. Increasingly, universities are turning into transnational corporations, and the idea of culture is being replaced by the discourse of "excellence." On the surface, this does not seem particularly pernicious.
The author cautions, however, that we should not embrace this techno-bureaucratic appeal too quickly. The new University of Excellence is a corporation driven by market forces, and, as such, is more interested in profit margins than in thought. Readings urges us to imagine how to think, without concession to corporate excellence or recourse to romantic nostalgia within an institution in ruins. The result is a passionate appeal for a new community of thinkers.

The multiversity that Clark Kerr so presciently discovered now finds itself in an age of apprehension with few certainties. Leaders of institutions of higher learning can be either hedgehogs or foxes in the new age. Kerr gives five general points of advice on what kinds of attitudes universities should adopt. He then gives a blueprint for action for foxes, suggesting that a few hedgehogs need to be around to protect university autonomy and the public weal.
The University and the People chronicles the influence of Populism—a powerful agrarian movement—on public higher education in the late nineteenth century. Revisiting this pivotal era in the history of the American state university, Scott Gelber demonstrates that Populists expressed a surprising degree of enthusiasm for institutions of higher learning. More fundamentally, he argues that the mission of the state university, as we understand it today, evolved from a fractious but productive relationship between public demands and academic authority.
Populists attacked a variety of elites—professionals, executives, scholars—and seemed to confirm academia’s fear of anti-intellectual public oversight. The movement’s vision of the state university highlighted deep tensions in American attitudes toward meritocracy and expertise. Yet Populists also promoted state-supported higher education, with the aims of educating the sons (and sometimes daughters) of ordinary citizens, blurring status distinctions, and promoting civic engagement. Accessibility, utilitarianism, and public service were the bywords of Populist journalists, legislators, trustees, and sympathetic professors. These “academic populists” encouraged state universities to reckon with egalitarian perspectives on admissions, financial aid, curricula, and research. And despite their critiques of college “ivory towers,” Populists supported the humanities and social sciences, tolerated a degree of ideological dissent, and lobbied for record-breaking appropriations for state institutions.
An essential American dream—equal access to higher education—was becoming a reality with the GI Bill and civil rights movements after World War II. But this vital American promise has been broken. Christopher Newfield argues that the financial and political crises of public universities are not the result of economic downturns or of ultimately valuable restructuring, but of a conservative campaign to end public education’s democratizing influence on American society. Unmaking the Public University is the story of how conservatives have maligned and restructured public universities, deceiving the public to serve their own ends. It is a deep and revealing analysis that is long overdue.
Newfield carefully describes how this campaign operated, using extensive research into public university archives. He launches the story with the expansive vision of an equitable and creative America that emerged from the post-war boom in college access, and traces the gradual emergence of the anti-egalitarian “corporate university,” practices that ranged from racial policies to research budgeting. Newfield shows that the culture wars have actually been an economic war that a conservative coalition in business, government, and academia have waged on that economically necessary but often independent group, the college-educated middle class. Newfield’s research exposes the crucial fact that the culture wars have functioned as a kind of neutron bomb, one that pulverizes the social and culture claims of college grads while leaving their technical expertise untouched. Unmaking the Public University incisively sets the record straight, describing a forty-year economic war waged on the college-educated public, and awakening us to a vision of social development shared by scientists and humanists alike.
Faculty members who care about the institutions of higher education where they work are often at odds with university management. In his forceful book, Under New Management, Randy Martin takes a novel, evenhanded approach to this gulf between professors, who feel a loss of autonomy, and administrators.
Martin imagines a political future for academic labor based on a critical understanding of the administrative work that faculty already undertake. He considers the differences between self-rule and specialized expertise and provides a case study of a New York City public school to show how kids and families respond to the demands of managerial productivity that is part of preparing students for college. Under New Management also considers changes faced by students, faculty, and administrators in light of this reworked social compact of professionals.
U.S.-China relations became increasingly important and complex in the twentieth century. While economic, political, and military interactions all grew over time, the most dramatic expansion took place in educational exchange, turning it into the strongest tie between the two nations. By the end of the 1940s, tens of thousands of Chinese and American students and scholars had crisscrossed the Pacific, leaving indelible marks on both societies. Although all exchange programs were terminated during the cold war, the two nations reemerged as top partners within a decade after the reestablishment of diplomatic relations.
Approaching U.S.-China relations from a unique and usually overlooked perspective, Hongshan Li reveals that both the drastic expansion and complete termination of educational ties between the two nations in the first half of the twentieth century were largely the results of direct and deep intervention from the American and Chinese governments. Benefiting from government support and collaboration, educational exchange succeeded in diffusing knowledge and improving mutual understanding between the two peoples across the divide of civilizations. However, the visible hand of government also proved to be most destructive to the development of healthy intercultural relations when educational interactions were treated merely as an instrument for crisis management.
The moment is right for critical reflection on what has been assumed to be a core part of schooling. In Ungrading, fifteen educators write about their diverse experiences going gradeless. Some contributors are new to the practice and some have been engaging in it for decades. Some are in humanities and social sciences, some in STEM fields. Some are in higher education, but some are the K–12 pioneers who led the way. For decades, leaders in higher education have voiced their intention to expand college education to include disadvantaged groups. Colleges have embraced and defended public policies that push back against discrimination and make college more affordable. And yet, as the economist Charles Clotfelter shows, America’s system of undergraduate education was unequal in 1970 and is even more so today.
In Unequal Colleges in the Age of Disparity, Clotfelter presents quantitative comparisons across selective and less selective colleges from the 1970s to the present, in exploration of three themes: diversity, competition, and inequality. Diversity shows itself in the variety of colleges’ objectives but also in the disparity of the material and human resources at their disposal. Competition operates through both the supply and the demand sides of the market, with college admissions becoming more meritocratic even as the most desirable colleges choose to contend fiercely for top-tier students rather than accommodate rising numbers of qualified applicants. Clotfelter shows that exclusive colleges have also benefited disproportionately from America’s growing income inequality. As their endowments have ballooned, their students have become more academically advantaged, owing in part to the extraordinary steps affluent families take to groom their children for college admission.
Clotfelter finds that despite a revolution in civil rights, billions spent on financial aid, and the commitment of colleges to greater equality, stratification has grown starker. Top colleges cater largely to children of elites.
How special education used disability labels to marginalize Black students in public schools
The Unteachables examines the overrepresentation of Black students in special education over the course of the twentieth century. As African American children integrated predominantly white schools, many were disproportionately labeled educable mentally retarded (EMR), learning disabled (LD), and emotionally behavioral disordered (EBD). Keith A. Mayes charts the evolution of disability categories and how these labels kept Black learners segregated in American classrooms.
The civil rights and the educational disability rights movements, Mayes shows, have both collaborated and worked at cross-purposes since the beginning of school desegregation. Disability rights advocates built upon the opportunity provided by the civil rights movement to make claims about student invisibility at the level of intellectual and cognitive disabilities. Although special education ostensibly included children from all racial groups, educational disability rights advocates focused on the needs of white disabled students, while school systems used disability discourses to malign and marginalize Black students.
From the 1940s to the present, social science researchers, policymakers, school administrators, and teachers have each contributed to the overrepresentation of Black students in special education. Excavating the deep-seated racism embedded in both the public school system and public policy, The Unteachables explores the discriminatory labeling of Black students, and how it indelibly contributed to special education disproportionality, to student discipline and push-out practices, and to the school-to-prison pipeline effect.

As new media empower practically anyone to produce and disseminate knowledge, learning can now occur at any time and any place. A University Turns to the World examines the growth of Michigan State University’s pacesetting International program beginning in 1956, when President John Hannah named the nation’s first international dean, Glen Taggart, to head a university-wide effort. In the years that followed, MSU’s technical assistance projects in Asia, Africa, and Latin America were an important contribution to economic growth and development, and they were integral to broad efforts to strengthen the international dimension at home. The faculty members who went to Okinawa, Colombia, Brazil, South Vietnam, and Pakistan in the early years defined important goals and they learned much. As the years passed, their experiences led to increased sensitivity to the complexities of development activity and the need for patience.
Smuckler’s leadership of the international program and intimate involvement in MSU’s work at home and abroad enable him to recapture the dreams and disappointments of the development promise. Ultimately, Smuckler demonstrates that the development programs of the mid-twentieth century paved the way for valuable new research activities and long-term mutually beneficial ties between MSU faculty and institutions and colleagues overseas.

Southern women of all classes, races, and walks of life practiced music during and after the Civil War. Candace L. Bailey examines the history of southern women through the lens of these musical pursuits, uncovering the ways that music's transmission, education, circulation, and repertory help us understand its meaning in the women's culture of the time. Bailey pays particular attention to the space between music as an ideal accomplishment—part of how people expected women to perform gentility—and a real practice—what women actually did. In this fresh approach to musical theatre history, Bruce Kirle challenges the commonly understood trajectory of the genre. Drawing on the notion that the world of the author stays fixed while the world of the audience is ever-changing, Kirle suggests that musicals are open, fluid products of the particular cultural moment in which they are performed. Incomplete as printed texts and scores, musicals take on unpredictable lives of their own in the complex transformation from page to stage.
Using lenses borrowed from performance studies, cultural studies, queer studies, and ethnoracial studies, Unfinished Show Business: Broadway Musicals as Works-in-Process argues that musicals are as interesting for the provocative issues they raise about shifting attitudes toward American identity as for their show-stopping song-and-dance numbers and conveniently happy endings. Kirle illustrates how performers such as Ed Wynn, Fanny Brice, and the Marx Brothers used their charismatic personalities and quirkiness to provide insights into the struggle of marginalized ethnoracial groups to assimilate. Using examples from favorites including Oklahoma!, Fiddler on the Roof, A Chorus Line, and Les Misérables, Kirle demonstrates Broadway’s ability to bridge seemingly insoluble tensions in society, from economic and political anxiety surrounding World War II to generational conflict and youth counterculture to corporate America and the “me” generation. Enlivened by a gallery of some of Broadway’s most memorable moments—and some amusing, obscure ones as well—this study will appeal to students, scholars, and lifelong musical theatre enthusiasts.
In the 1910s and 1920s, Black musicians organized more than fifty independent locals within the American Federation of Musicians (AFM) in an attempt to control audition criteria, set competitive wages, and secure a voice in national decision-making. Leta Miller follows the AFM’s history of Black locals, which competed directly with white locals in the same territories, from their origins and successes in the 1920s through Depression-era crises to the fraught process of dismantling segregated AFM organizations in the 1960s and 70s. Like any union, Black AFM locals sought to ensure employment and competitive wages for members with always-evolving solutions to problems. Miller’s account of these efforts includes the voices of the musicians themselves and interviews with former union members who took part in the difficult integration of Black and white locals. She also analyzes the fundamental question of how musicians benefitted from membership in a labor organization.
Broad in scope and rich in detail, Union Divided illuminates the complex working world of unionized Black musicians and the AFM’s journey to racial inclusion.
What happens when operas that are comfortably ensconced in the canon are thoroughly rethought and radically recast on stage? What does a staging do to our understanding of an opera, and of opera generally? While a stage production can disrupt a work that was thought to be established, David J. Levin here argues that the genre of opera is itself unsettled, and that the performance of operas, at its best, clarifies this condition by bringing opera’s restlessness and volatility to life.
Unsettling Opera explores a variety of fields, considering questions of operatic textuality, dramaturgical practice, and performance theory. Levin opens with a brief history of opera production, opera studies, and dramatic composition, and goes on to consider in detail various productions of the works of Wagner, Mozart, Verdi, and Alexander Zemlinsky. Ultimately, the book seeks to initiate a dialogue between scholars of music, literature, and performance by addressing questions raised in each field in a manner that influences them all.
An Unnatural Attitude traces a style of musical thought that coalesced in the intellectual milieu of the Weimar Republic—a phenomenological style that sought to renew contact with music as a worldly circumstance. Deeply critical of the influence of naturalism in aesthetics and ethics, proponents of this new style argued for the description of music as something accessible neither through introspection nor through experimental research, but rather in an attitude of outward, open orientation toward the world. With this approach, music acquires meaning in particular when the act of listening is understood to be shared with others.
Benjamin Steege interprets this discourse as the response of a young, post–World War I generation amid a virtually uninterrupted experience of war, actual or imminent—a cohort for whom disenchantment with scientific achievement was to be answered by reasserting the value of imaginative thought. Steege draws on a wide range of published and unpublished texts from music theory, pedagogy, criticism, and philosophy of music, some of which appear for the first time in English translation in the book’s appendixes. The varied forms of Leonard Bernstein’s musical creativity have been recognized and enjoyed by millions. Drawing on his insights as a master composer and conductor, Mr. Bernstein also explores what music means below the surface: the symbols and metaphors which exist in every musical piece, of whatever sort. And, finally, Mr. Bernstein analyzes twentieth century crises in the music of Schoenberg and Stravinsky, finding even here a transformation of all that has gone before, as part of the poetry of expression, through its roots in the earth of human experience.
These talks, written and delivered when Leonard Bernstein was Charles Eliot Norton Professor of Poetry at Harvard University, are the newest of the author’s literary achievements. In addition to a distinguished career as conductor, pianist, and composer, Mr. Bernstein is the recipient of many television Emmys for the scripts of his Young People’s Concerts, Omnibus programs, and others, and is the author of The Infinite Variety of Music and The Joy of Music, for which he received the Christopher Award.
Analyses of the work of individual artists are grouped around three major themes that Asian American artists engaged with during the 1990s: representations of the Other; social memory and trauma; and migration, diaspora, and sense of place. Machida considers the work of the photographers Pipo Nguyen-duy and Hanh Thi Pham, the printmaker and sculptor Zarina Hashmi, and installations by the artists Tomie Arai, Ming Fay, and Yong Soon Min. She examines the work of Marlon Fuentes, whose films and photographs play with the stereotyping conventions of visual anthropology, and prints in which Allan deSouza addresses the persistence of Orientalism in American popular culture. Machida reflects on Kristine Aono’s museum installations embodying the multigenerational effects of the internment of Japanese Americans during World War II and on Y. David Chung’s representations of urban spaces transformed by migration in works ranging from large-scale charcoal drawings to multimedia installations and an “electronic rap opera.”

Fifty years ago a landmark conference at Harvard University established urban design as a distinct architectural and planning practice. Today, with the world’s urban population surpassing three billion people, urban design has become more crucial than ever. A celebrated sculptor, he was a leading figure of the young Soviet art establishment in the early 1920s. The mentor to an entire generation of Soviet sculptors, he was renowned for his personal charisma and artistic versatility. This collection of essays, interviews, and personal reminiscences is the first appraisal of his work and life published outside of Russia.
The contributors view Konenkov’s work within a variety of cultural, artistic, and philosophical contexts. With particular attention to his awareness of both indigenous Russian traditions and European innovations, they trace the many stages of his artistic development as he explored and experimented with techniques borrowed from Realism, Symbolism, salon portraiture, African wood carving, Socialist Realism, and Surrealism. The many different historical sources that inspired Konenkov’s artistic expression, from Orthodox Christianity and the folklore of the Russian peasantry to the Egyptian pyramids and pre-classical antiquity are also discussed. The contributors also explore the relationship of Konenkov's life and ideology to art, and the effects of expatriation on creativity.

This comprehensive view of the Orpheus myth in modern art focuses on an extremely rich artistic symbol and cuts through all the clichés to explore truly significant problems of meaning. The author takes a new approach to the iconography of major modern artists by incorporating psychological and literary analysis, as well as biography.
The three parts of the book explore the ways in which artists have identified with different aspects of the often paradoxical Orpheus myth. The first deals with artists such as Paul Klee, Carl Milles, and Barbara Hepworth. In the second, Max Beckmann, Oskar Kokoschka, and Isamu Noguchi are discussed. Artists examined in the final part include Pablo Picasso, Jacques Lipchitz, Ethel Schwabacher, and Cy Twombly. The author documents her argument with more than sixty illustrations.
In September 1999, Sensation, an exhibition at the Brooklyn Museum, opened its doors, igniting a controversy still burning in the art world. This collection of cutting-edge art from the Saatchi collection in England, and the museum’s arrangements with Charles Saatchi to finance the show, so offended New York City mayor Rudolph Giuliani that he attempted to shut the museum down by withholding city funds that are crucially needed by that institution. Only a legal ruling prevented him from doing so. Like the Robert Mapplethorpe exhibition before it, Sensation once again raises questions about public spending for “controversial” art, but with the added dimension of religious conflict and charges of commercialization.
The contributors to this volume use the Sensation exhibition as a stepping-stone to analyze larger questions such as the authority the government has to withhold funds, various interpretations of the First Amendment, how to respect divergent cultural and religious values; and the economic stake of museums and dealers in art. In their articles—written expressly for this volume, and spanning the disciplines of law, cultural studies, public policy, and art—the contributors consider issues at the center of arts policy. They propose various legal strategies, curatorial practices, and standards of doing business intended to serve the public interest in the arts.
An ethnography of the decolonization of Maya-ness.
On the Yucatán Peninsula today, undergraduates are inventing a new sense of being Maya by studying linguistics and culture in their own language: Maya. In this bold theoretical intervention informed by ethnographic research, Catherine R. Rhodes argues that these students are undoing the category of modernity itself. Created through colonization of the Americas, modernity is the counterpart to coloniality; the students, Rhodes suggests, are creating decoloniality’s companion: “demodernity.”
Disciplines like linguistics, anthropology, history, and archaeology invented “the Maya” as an essentialized ethnos in a colonial, modern mold. Undoing Modernity follows students and their teachers as they upset the seemingly stable ethnic definition of Maya, with its reliance on a firm dichotomy of Maya and modern. Maya linguistics does not prove that Maya is modern but instead rejects the Maya-ness that modernity built, while also fostering within the university an intellectual space in which students articulate identity on their own terms. An erudite and ultimately hopeful work of interdisciplinary scholarship that brings linguistic anthropology, Mesoamerican studies, and critical Indigenous studies into the conversation, Undoing Modernity dares to imagine the world on the other side of colonial/modern ideals of Indigeneity.
This book mounts a sustained attack on ideas that are dear to many practitioners of analytic philosophy. Charles Travis targets the seductive illusion that—in Wittgenstein’s terms—“if anyone utters a sentence and means or understands it, he is operating a calculus according to definite rules.” This book rejects the idea that thoughts are essentially representational items whose content is independent of context. In doing so, it undermines the foundations of much contemporary philosophy of mind.
Travis’s main argument in Unshadowed Thought is that linguistic expressions and forms are occasion-sensitive; they cannot be abstracted out of a concrete context. With compelling examples and a thoroughgoing scrutiny of opposing positions, his book systematically works out the implications of the work of J. L. Austin, Hilary Putnam, and John McDowell. Eloquently insisting that there is no particular way one must structure what one relates to, no one way one must represent it, Unshadowed Thought identifies and resists a certain strain of semantic Platonism that permeates current philosophy—a strain that has had profoundly troubling consequences for our ideas about attitudes and beliefs and for our views about what language might be.
